Terms and Conditions

Contract :

The Contract for a short-term holiday let at Dallachulish Lodge, Creagan, Argyll shall be between the client and Ross MacPherson and shall be governed by Scottish Law. Once the initial deposit has been received and confirmation issued on behalf of Ross MacPherson the contract shall be considered to be legally binding on both parties. The contract shall be subject to the following booking conditions:

Reservations :
A reservation is confirmed when you have received an email from us that details:
The date of arrival and departure and the tariff.
That any deposit required has been paid and a confirmation of this payment given.

The balance of the holiday rental is payable 6 weeks prior to the arrival date.

Where a booking is confirmed less than 6 weeks prior to arrival payment must be made in full. Payment may be made by BACS bank transfer, by cheque (UK Sterling) or by Credit/Debit Card.

Care of the Property :
The client will be responsible for ensuring that the conditions of let are adhered to and is legally bound to notify Ross MacPherson of any breakages or damage to the property and to reimburse him for replacement, repair or extra cleaning costs on demand. The client shall take all reasonable and proper care of the property and its contents and shall leave them in the same state of repair and clean and tidy condition at the end of the period of rental as provided at the beginning.

Excess cleaning charge.
The client has a commitment to take care of the property during their stay and to leave it in a reasonable condition on departure. It is also your agreement to pay for any breakages for which you are responsible. Should any specialist cleaning be required after the tenancy, or any breakages are evident, to cover the cost of this an invoice will be raised and charged to the client.

Cancellation Insurance :
We strongly recommend that you take out adequate holiday insurance to cover any costs you might incur if you have to cancel your holiday, as Ross MacPherson does not provide any insurance under the terms of your holiday rental agreement. Force majeure :
We cannot accept responsibility or pay any compensation where the performance or prompt performance of our contract with you is prevented or affected by reason of circumstances which amount to “force majeure”

Circumstances amounting to “force majeure” include any event which we or the owner could not, even with all due care, foresee or avoid. Such circumstances include the destruction or damage of the property (which cannot reasonably be remedied to a satisfactory standard before the start of your holiday) through fire, flood, explosion, storm or other weather damage, break-in, criminal damage or any similar event beyond our or the owner’s control. Such circumstances also include riots or civil strife, industrial action, natural or nuclear disaster, fire, adverse weather conditions, war or threat of war, actual or threatened terrorist activity and all similar situations beyond our control.

Personal Property :
Personal property is your own responsibility. Vehicles are left at your own risk.

Period of Let :
The period of let runs from 4 pm on the day of arrival and terminates at 10:00am on the day of departure.

Age of guests :

Dallachulish Lodge is suitable for children aged 10 years and older. The design and furnishing of the Lodge and it’s perimeter are not suitable for young children or babies and they cannot be accommodated at the property.

Strictly No Pets

Smoking :
Strictly No Smoking

Conditions of Let :
Dallachulish Lodge is to be used for the purpose of a holiday let only and is not an assured tenancy under the terms of the Housing (Scotland) Act 1988. You therefore only have the right to occupy the property for the agreed period of rental for holiday purposes only in terms of Schedule 4 of the aforementioned Act.

We reserve the right to refuse entry to anyone who, in our opinion, is not suitable to take occupation of the property. In such cases all payments shall be refunded and the contract terminated without further liability. Stag and hen parties are prohibited.

We also reserve the right to terminate the Contract at any time or remove any persons due to unreasonable behaviour, damage to property or causing annoyance or offence to other parties. In such cases any refund shall be at the discretion of Ross MacPherson or his representative.

Cancellation Policy :
All cancellations must be made in writing.
In the event of cancellation by the client Ross MacPherson shall be entitled to retain if already paid or to recover from the client the following percentage shares of the holiday rental.

If you cancel:
• More than 42 days (6 weeks): Loss of deposit..
• 28 days or less: 50% of the accommodation cost.
• 14 days or less: 100% of the accommodation cost.

When we have received notification of a cancellation we will try to re-let the property.

If we are successful in re-letting the property you will receive a refund as follows:

If you cancel:

• 42 days or less: Refund of the payments made less £50 administration/re-advertising fee.

If for any reason the accommodation is not available on the confirmed booking dates due to events beyond our reasonable control all monies paid will be refunded. Ross MacPherson will have no further liability to you or any other party.

Number of Persons in the property :
The number of persons occupying the property during the period of holiday let shall not exceed 6 guests as designated on our website and the reservation confirmation.

Complaints :
Should you have any cause for complaint during the period of holiday let this should be brought to our attention as soon as possible.

Right of Entry :
Ross MacPherson or a representative shall be given right of access to the property at all reasonable times for the purposes of repair and maintenance or routine inspection.

Terms & Conditions :
Ross MacPherson or his representative reserves the right to change or amend the terms and conditions at any time.                 December 2018
